General eligibility requirements

No matter where you apply, you must:

  • prove to an officer that you will leave Canada when your work permit expires,
  • show that you have enough money to take care of yourself and your family members during your stay in Canada and to return home,
  • obey the law and have no record of criminal activity (we may ask you to give us a police clearance certificate),
  • not be a danger to Canada’s security,
  • be in good health and have a medical exam, if needed,
  • not plan to work for an employer listed with the status “ineligible” on the list of employers who failed to comply with the conditions,
  • not plan to work for an employer who, on a regular basis, offers striptease, erotic dance, escort services or erotic massages, and
  • give the officer any other documents they ask for to prove you can enter the country.

Global Skills Strategy applicants: You can only benefit from two-week application processing if you apply from outside of Canada.

What is a study permit?

The study permit is a document we issue that allows foreign nationals to study at designated learning institutions (DLI) in Canada.

While studying in Canada under a study permit you must:

  • always be enrolled at a DLI
  • make progress towards completing your program
  • respect any conditions listed on your study permit
  • stop studying if you no longer meet the requirements and
  • leave Canada when your permit expires

Depending on your case, there may be conditions on your study permit such as:

  • the level of studies you can attend
  • if you are allowed to work in Canada
  • if you can’t travel within Canada
  • the date you must stop studying

Your relatives can live, study and work in Canada if they become permanent residents of Canada. You can sponsor certain relatives to come to Canada if you’re at least 18 years old and a:

  • Canadian citizen or
  • person registered in Canada as an Indian under the Canadian Indian Act or
  • permanent resident of Canada

Changes to citizenship requirements

On October 11, 2017, some changes to the Citizenship Act as a result of Bill C-6 become law. Here are some of the changes that you need to know about before applying for your citizenship.

Physical presence

You must be physically present in Canada for 3 out of the last 5 years with no minimum number of days per year, before applying for citizenship.

Previously: You had to be physically present in Canada for 4 out of 6 years, with a minimum of 183 days in each of the 4 years, before applying for citizenship.

Days spent in Canada before becoming a permanent resident (as a temporary resident or protected person) within 5 years of applying for citizenship, count as ½ days, up to a maximum of 1 year (365 days).

Previously: The time spent in Canada before becoming a permanent resident did not count towards the physical presence requirement for citizenship.

Language and knowledge

If you are between 18 years old and 54 years old, you must:

  • Meet language (English or French) requirements
  • Take the Citizenship Test

Previously: If you were between 14 and 64 years, you had to meet the language and knowledge requirement for citizenship.

Income tax

You have to file Canadian income taxes (if required to do so under the Income Tax Act) for 3 out of 5 years, matching the new physical presence requirement.

Previously: You had to file Canadian income taxes, if required to do so under the Income Tax Act, for 4 out of 6 years.

All the changes take effect on October 11, 2017
